Sorry, I don't see the problem. He made mode apem? No problem here. Ernie/3foo2. made it possible to vote for -em, therfore this is not forbidden, and rules don't say that this is forbidden. So actually this have nothing to do with getting him banned, just because he wants to play easy mode.
